Introduction

These Terms of Service ("Terms") govern your use of the MoguMe mobile application ("App") operated by MoguMe ("we", "our", or "us"). By downloading, installing, or using the App you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Service Description

MoguMe is a restaurant-discovery app that uses your device's GPS location to find nearby dining options and presents them through a swipe-based interface. Restaurant data is retrieved in real time from the Google Maps Platform / Places API. We do not operate, own, or endorse any of the restaurants listed in the App.

Search results are limited to a maximum of 20 restaurants per query. You can adjust search filters (walking time, minimum rating, price range) to refine results.

3. Subscriptions, Billing, and Cancellation

The Premium Plan is offered as an auto-renewing subscription through the App Store (Apple) or Google Play Store (Google). By subscribing you authorize the respective platform to charge your payment method on a recurring basis at the displayed price.

Cancellation

You may cancel your subscription at any time through the subscription management settings of your platform (iOS: Settings → Apple ID → Subscriptions; Android: Google Play → Subscriptions). Cancellation takes effect at the end of the current billing period; you retain premium access until then.

Account Transfer

Subscriptions are tied to the Apple ID or Google account used at the time of purchase. Transferring a subscription to a different account is not possible. If you use the same account on a new device, you can restore your premium status via the "Restore Purchases" option within the App.

Refund Policy

Subscription payments are processed and managed by Apple or Google, not by us. Refund requests must be submitted directly to the platform in accordance with their respective refund policies:

We do not issue refunds directly. However, if you experience a billing error attributable to us, contact us at the address in Section 9 and we will work with the platform to resolve it.

4. Location Data

The App requests foreground location access to identify restaurants near your current position. Location data is transmitted to Google's servers as part of each Places API request. We do not store or log your location data on our servers. You may deny location permission at any time through your device settings; however, the core functionality of the App will not be available without it.

Restaurant data displayed in the App is provided by the Google Maps Platform under Google's Terms of Service. You agree to comply with the Google Maps Platform Terms of Service. In particular:

Violation of any of the above may result in immediate suspension or termination of your access to the App without prior notice. We reserve the right to pursue any legal remedies available.

7. Disclaimer of Warranties

Restaurant information displayed in the App — including but not limited to name, address, operating hours, seating capacity, menu prices, and ratings — is sourced from the Google Places API and may be inaccurate, outdated, or incomplete. We make no warranty, express or implied, regarding the accuracy, reliability, or availability of any restaurant information. We strongly recommend confirming details directly with the restaurant before visiting.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of Japan, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the Tokyo District Court (or the Tokyo Summary Court for small claims).

If you are a consumer resident in the EEA or the United Kingdom, you may also be entitled to bring claims before the courts of your country of habitual residence, and nothing in these Terms limits your statutory rights as a consumer.

10. Changes to These Terms

We may update these Terms at any time. The "Last updated" date at the top of this page will reflect changes. For material changes, we will provide notice through the App or by other appropriate means. Continued use of the App after the effective date of updated Terms constitutes your acceptance of those Terms.
